Terms of Service for Professional Organizing Services

These Terms of Service (“Agreement”) govern the use of professional organizing services provided by [Versatile Freelancer/Jeanie Vela] (“the Organizer,” “we,” “our,” or “us”) to you, the Client (“you” or “Client”). You agree to be bound by the terms outlined below by engaging with our services.
Services Provided
We may collect the following types of information when you visit our website or use our services:
The Organizer offers professional organizing services to help clients declutter, organize, and streamline their homes or offices. Services include but are not limited to:
- Home Organizing
- Office Organizing
- Digital Organizing
- Packing and Unpacking Services
- Decluttering Services
- Project Management and Consulting
Services will be provided based on a mutually agreed-upon scope, schedule, and pricing.
Scheduling & Appointments
Initial Consultation: A complimentary or paid consultation may be required to assess the needs of the Client, review space, and determine the appropriate services.
Appointments: Appointments will be scheduled based on availability and mutual agreement. If you need to reschedule or cancel an appointment, we request at least 48 hours’ notice. Cancellations will incur a cancellation fee of [$50].
Late Arrivals & Cancellations: If you are more than 30 minutes late without prior notice, your appointment may be rescheduled, and the full session fee may apply.
Fees & Payment Terms
Fees: Fees are based on an hourly rate, package rate, or flat fee, depending on the service provided. All pricing will be clearly communicated before services start.
Payment: Full payment is due upon completion of services unless otherwise agreed upon. We accept [list payment methods, e.g., credit cards, checks, PayPal].
Refunds: We do not offer refunds for services rendered, but we will work with you to address any concerns during or after the service.
Client Responsibilities
Space Preparation: The Client agrees to ensure that the space to be organized is safe and free from hazards. The Client is responsible for removing items of high value or personal significance before the session begins.
Decision Making: The Client is responsible for decisions related to item disposal, donation, or retention. We can offer recommendations, but the client will make all final decisions.
Confidentiality: We respect your privacy. We will not share personal information or details about your space without your consent, except as required by law.
Intellectual Property
Client Materials: The Client retains ownership of all intellectual property they provide to the Company (e.g., logos, designs, photos).
Company Materials: By engaging in professional organizing services, the client acknowledges that all materials created for the project, including but not limited to organizational plans, designs, strategies, and related documentation, are the sole property of the organizer unless otherwise agreed upon in a separate written contract. The organizer reserves the right to modify, retain, and use these materials for promotional purposes, which may include showcasing them in the organizer’s business portfolio, on websites, social media platforms, and in marketing presentations.
By proceeding with the project, the client grants the organizer permission to utilize these materials for such promotional purposes without requiring additional approval or compensation. This provision enables the organizer to highlight their expertise and attract future business opportunities.
Permissions and Use of Content
By engaging with and participating in any project managed by [Organizer’s Name/Company], all clients and collaborators grant permission for [Organizer’s Name/Company] to capture photographs and videos of completed work. These images and videos may be used for promotional purposes, including but not limited to marketing materials, social media, websites, and other promotional platforms. By allowing access to your project, you acknowledge and agree that these photos and videos may be stored and utilized by [Organizer’s Name/Company] for the duration of its business operations. No compensation will be provided for the use of these materials. If you prefer not to have your project documented, please inform the organizer in advance.
Organizer’s Responsibilities
Professional Conduct: The Organizer will provide services with care, professionalism, and respect for your property and belongings.
Communication: We will provide updates and recommendations during the organizing process, including any concerns that may arise. If any changes to the original agreement are necessary, we will discuss them with you in advance.
Property & Liability
Damage to Property: The Organizer will take all reasonable precautions to avoid property damage. However, the Organizer is not liable for any damage that may occur to property, furniture, or belongings during the course of organizing services.
Insurance: The Organizer carries general liability insurance. We recommend that Clients maintain their own property insurance.
Privacy & Data Protection
Confidentiality of Personal Information: We will not disclose any personal information or details of your space to third parties except as required by law.
Digital Data: If digital organizing services are provided, we will take necessary precautions to protect your data. However, we cannot be held liable for data loss or breaches.
Limitation of Liability
To the fullest extent permitted by law, the Organizer’s liability for any claims, losses, or damages related to the services provided is limited to the amount paid for the specific services rendered. The Organizer is not liable for any indirect, incidental, or consequential damages.
Indemnification
The Client agrees to indemnify and hold harmless the Organizer from any claims, damages, or expenses arising from any third-party claims, including but not limited to personal injury, property damage, or legal actions arising from the Client’s use of the services.
Termination of Services
Either party may terminate this agreement with written notice. If the Client decides to terminate the services, payment for any work completed up to that point will still be due. The Organizer reserves the right to terminate services if the Client violates these terms or engages in inappropriate conduct.
Right to Refuse Service
We respectfully reserve the right to decline service to any individual or entity at our sole discretion, consistent with our Christian values. This may include, but is not limited to, situations where providing service may conflict with those values. Our mission is to foster a respectful, faith-driven environment reflecting our Christian principles.
In addition, we reserve the right to refuse service to individuals engaging in violent or disruptive behavior and those presenting contagious health risks in order to protect the safety, well-being, and comfort of all our customers and staff. We appreciate your cooperation in helping us maintain a respectful and secure environment.
As a service provider, we fully comply with state and federal anti-discrimination laws, prohibiting discrimination based on protected characteristics such as race, color, national origin, sex, or disability.
Should we be unable to fulfill your request, we are happy to provide referrals to other businesses or services that may be able to assist you.
Dispute Resolution
In the event of any dispute, the parties agree to resolve the matter through good-faith negotiations. If negotiations fail, the parties may agree to mediation or arbitration.
Governing Law
This Agreement shall be governed by and construed by the laws of the state or country where the Organizer operates.
Amendments
The Organizer reserves the right to modify these Terms of Service at any time. Any changes will be communicated to the Client in writing. Continued use of services after any changes constitutes acceptance of the revised Terms.
Miscellaneous
Severability: If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement: This Agreement constitutes the entire understanding between the Client and the Organizer, superseding any prior agreements or discussions.
